How we collect information from users
How we gather and store your information depends on the page(s) you visit, the programs/services in which you opt to participate, and the programs/services we provide. For instance, you may be requested to provide certain information when you enroll in a program, submit an application, request information, or request particular features, such as access to a Webinar, or when you elect to make a purchase. Like most websites, PogoFish Media also gathers information automatically and through utilizing electronic tools which may be transparent to you, our visitor. For instance, we may log the business name of your Internet Service Provider, or utilize cookie technology in order to retain information from your visit, and to recognize you upon return. Among other functions, a cookie may retain your user name and password, enabling you to easily reenter a program or webpage upon your subsequent visits. In the future as PFM adopts additional and updated technologies, we may collect information through additional means. In some instances, you’ll be able to opt to not provide your information, for instance, by altering your browser settings to disallow cookies, but should you choose to do so, access to some areas of our website may become inaccessible, or you may be requested to enter your user name and password upon each visit.
How we use the information we gather
As noted above, we gather information to provide to you the products, solutions, and services you request, as well as to share with you any new and related products, solutions, and services PFM produces that may provide additional benefit and value to you, or which we believe might be of interest to you. Aggregated information (which doesn’t identify you personally) may be utilized in a number of ways. For instance, we may merge information regarding patterns of your usage of our site with like information we collect from other visitors in order to augment our products, solutions, services, and the site itself with the most beneficial and valuable offerings possible. To repeat, no personally identifiable information about you is gathered through aggregation.
The personally identifiable information PFM collects may additionally be utilized in other ways, which includes but is not limited to administration of the website, processing your e-commerce transaction(s), troubleshooting, and replies to your inquiry(ies) and other exchanges of communication with you. Particular third parties which participate in technical operation of our site (for instance, our web-hosting service) may access this information. We utilize your information as permitted by law only. In required response to a court order, we may also disclose information you have shared, at times we believe law requires us to do so, related to collection of any amounts you may owe to PFM, and/or to law-enforcement authorities at any time we deem doing so necessary or appropriate. Note that we are not required by law, and may not provide, advance notice to you of disclosure in cases such as these.

PogoFish Media does not solicit or knowingly collect personally identifiable information about or from children under the age of thirteen except as law permits. If ever we discover we’ve received information from a juvenile under the age of thirteen in violation of law and/or this policy, PFM immediately deletes that information. If you discover or believe that PFM has received any information about or from any person under the age of thirteen, please apprise us of this immediately at our address, which is listed below in the links menu.

Inclusion of portfolio samples of our clients’ books; book covers; author, professional, or other photographs and videos; and similar media and materials for which we and/or our contractors have provided creative, design, development, photographic, videographic, and other assistance; whether purchased or unpurchased, whether published or unpublished; is done so according to fair use doctrine in the United States copyright law. Anyone who decides they no longer want their materials to be displayed in our portfolio may contact us at PogoFishMedia@gmail.com to have them removed.
If we are unable to achieve a mutually satisfactory resolution through the mediation, we agree that we will submit the dispute to binding arbitration at the following location: McHenry, Illinois, under the American Arbitration Association rules. Judgment on the arbitration-rendered award may be entered in any United States or other court that possesses the jurisdiction to do so.
PogoFish Media is controlled, administered, and operated entirely within the state of Illinois, with the exception of independent contractors who may provide services to this site’s visitors upon the request of said visitors. Such contractors may provide requested services completely independently of PogoFish Media, in locations outside Illinois.
The policies outlined herein, with the inclusion of this statement, aren’t intended to, and do not create, any legal or contractual rights on behalf of any individual, business, or other party.
